Truck Driver Charged After Fatal Accident with Motorcycle
A truck driver will be charged with homicide by vehicle and making an improper U-turn after his involvement in an accident that left a motorcyclist dead on an Atlanta road.
The crash happened at the intersection of Ferncliff Road and Lenox Road NE. The driver of the truck was in the far right lane and attempted to make a U-turn in the intersection. As he did so, he cut off the motorcyclist, who was heading the same way on the road. The motorcyclist attempted to skid to a stop, but ended up crashing into the truck just behind the cab. He was rushed to the hospital, but died from his injuries within a short amount of time.
In this particular accident, the truck driver could be liable for the crash because he failed to obey traffic laws, and his negligence led to the injury — and ultimately, the death — of another driver on the road. Investigators will also likely analyze the processes that his company took in hiring the driver, and whether he had a previous accident history. Depending on the findings of the investigation, the company could be liable for the accident, as well.
In addition, a situation like may be grounds for the victim’s family to file a wrongful death lawsuit against the driver — and potentially the trucking company. In these cases, the family could receive compensation amounting to what the motorcyclist would have likely received if he had survived and filed a personal injury claim on his own.
